SWAT Team Blows Up Innocent Woman’s Home, Tell Her that She Has to Pay the $50,000 Bill

5 December 2021

In July of last year, Vicki Baker, 75, was excited to move on to the next chapter of her life in Montana by selling her home she owned for 12 years in McKinney, Texas. That sale would never take place on schedule, however, because the day before she was supposed to close, a SWAT team destroyed it. After destroying her home, Baker was told by local government that she was on the hook for the $50,000 bill to repair it. After fighting for a year, however, she may finally see some justice after a federal court ruled this month that ...

A SWAT Team Blew Up This Innocent Woman's House and Cost Her Over $50,000. The City Tried To Stop Her From Suing.
A federal court wasn't having it.

29 November 2021

A SWAT team destroyed an innocent woman's house after a fugitive barricaded himself inside. Last week a federal court ruled that she can sue the government for damages. In July 2020, Wesley Little—who Vicki Baker had terminated as her handyman about a year and a half prior—arrived at Baker's home in McKinney, Texas. Baker's daughter answered. Recognizing him from news reports that he was wanted for the abduction of a 15-year-old girl, she left the premises and called the police. SWAT agents soon arrived. They set off explosives to open the garage entryway, detonated tear gas grenades inside the building, ...

Federal Court Says Destroying Someone's House To Apprehend A Fugitive Might Be A Constitutional Violation

21 December 2021

Law enforcement has a pretty cavalier attitude towards private property. Whatever property they aren't unjustifiably seizing from drivers and passengers, they're razing to the ground. Sometimes they destroy whole houses during plain vanilla warrant service. Other times, situations are determined to be stand-offs in need of wholesale destruction, even when officers are facing down an empty house. You'd think this sort of brazen and unjustified destruction would result in successful lawsuits to recover costs and damages incurred by these actions. But you'd be wrong. A successful lawsuit for law enforcement destruction of private property is more rare than a successful ...

This Innocent Woman's House Was Destroyed by a SWAT Team. A Jury Says She's Owed $60,000.
Such victims are often told they have no right to sue.

29 June 2022

When Vicki Baker cleared out her home in McKinney, Texas, in 2020, she filled two 40-foot dumpsters with her belongings. It wasn't the way she'd pictured emptying the house as she prepared to begin retirement in Montana. But there was little else to be done with her tear-gas stained items after a SWAT team careened through her fence, detonated explosives to blow her garage door off its hinges, smashed several windows, and drove a BearCat armored vehicle through her front door to apprehend a fugitive that had barricaded himself inside. A federal jury last week decided that Baker is entitled ...

Jury Says Texas City Must Pay Woman $60k After Cops Destroyed Her Home To Apprehend A Suspect

7 July 2022

Bucking a trend set by two separate Appeals Courts (Ninth and Tenth), a federal court in Texas has said it is actually a violation of rights when cops destroy an innocent person’s home to effect an arrest. What’s more, a jury has backed up that decision with actual compensation. (h/t The Honest Courtesan) Today, a federal jury ruled that Vicki Baker is entitled to $59,656.59 in damages after a SWAT team destroyed her McKinney, Texas, home while pursuing a fleeing fugitive in July 2020. The ruling is a victory for Vicki, who joined forces with the Institute for Justice (IJ) ...
