A Tuskha police officer was scheduled to appear in court Thursday after being arrested last month for being intoxicated while on duty. Tushka police and Atoka County deputies received complaints that Officer James Capps, 45, appeared to be inebriated on September 10 while responding to an accident at U.S. 69 and Boggy Depot Road in Tushka. According to the arrest affidavit, state troopers said Capps' breath smelled of alcohol and the officer failed a field sobriety test when he was arrested.
