The city of Clarkston dismissed all criminal charges against Mark Domino on Tuesday and agreed to pay him $25,000 to resolve a case that first made headlines more than a year ago. When Domino, 53, arrived in District Court for a pretrial hearing on his misdemeanor charges of resisting arrest and obstruction of a law enforcement officer, city attorney Todd Richardson asked to speak with him in a nearby conference room. About an hour later, Judge Tina Kernan called the case, and Richardson said a resolution had been reached, and the charges were being dropped. “This has been a difficult ...

The department has no history of racial bias, and the incident is under careful review, he said. “We haven’t received any formal complaints about this, but it did get a lot of attention on social media,” Hastings said. “Citizens are required to cooperate with lawful ...

Just because it’s legal doesn’t make it right

15 August 2019

The last point Clarkston Police Chief Joel Hastings made about the Mark Domino case was his most important. In his news release, Hasting said the events of June 24 and what has followed are “an opportunity for learning and will be used to enhance and improve the way our officers interact with the public moving forward.” But first, Hastings checked the legal boxes. In handling Domino, Hastings said his officers “acted within the law at all times and there was no violation of any policy or procedure.” Domino is the 52-year-old African-American man who was coming off a shift at ...

In November, he agreed not to sue the city of Clarkston or police officers Chris Lorz and Anthony Bennett, but Domino has yet to sign on the dotted line. “It seems like they’re trying to cover too much butt in the agreement,” Domino said. “I did agree not to ...

An Asotin County judge denied Mark Domino’s 34-page motion Tuesday to get his charges dropped, saying nothing new has been presented to the court since she made her previous rulings. Editorial: Why not forge a resolution to Domino’s case?

3 September 2020

Unrealistic expectations have kept the Mark Domino case alive long after it should have been settled. Start with Clarkston City Attorney Todd Richardson. He somehow thinks he can win the misdemeanor case stemming from Domino’s arrest 14 months ago on charges of resisting arrest and obstructing a law enforcement officer. How do you convict a victim of a false report? Clarkston police officers confronted Domino at the Walmart parking lot amid allegations that a Black man — Domino is African American — was prowling cars. Domino, a Walmart employee, was opening the doors of his wife’s car. How do you ...

Cheers & Jeers: Justice, at last

25 September 2019

CHEERS ... to Mark Domino. For 15 months, he stood up to: 1. Racial profiling — This all began in late June 2019, with a false report of a Black man prowling cars at the Clarkston Walmart. In fact, Domino, who is African American, worked at Walmart and was opening the doors of his wife’s car. Rather than scope out the scene, talk to other witnesses or even run Domino’s license plate through a mobile data terminal, two Clarkston police officers began interrogating him. As is his right, Domino declined to answer their questions. But the officers escalated the situation — ...
